1. Acceptance of these terms
These Terms of Service (“Termsâ€) are an agreement between you and WordPress Hosting (“weâ€,€œusâ€,€œourâ€). By creating an account, placing an order, or using our website, client area, or hosting services, you agree to these Terms, our Privacy Policy, and our Money-Back Guarantee. If you accept these Terms on behalf of a business, you confirm that you are authorised to bind that business.
2. Definitions
- “Services†means our managed WordPress hosting plans and everything included with them, such as storage, staging, business email, and access to the client area.
- “Account†means your customer account in our client area.
- “Content†means any websites, files, databases, emails, software, and other material that you or your users store or send using the Services.
- “End users†means visitors to your websites and anyone you give access to your Account.
3. Eligibility and your account
- You must be at least 18 years old, or the age of legal majority where you live, to open an Account.
- You must give accurate and complete information and keep it up to date.
- You are responsible for keeping your passwords and login details secure, and for all activity under your Account, including activity by anyone you give access to.
- Tell us immediately if you suspect unauthorised access to your Account.
- We may refuse or close Accounts that are opened with false information or that break these Terms.
4. Our services
We provide managed WordPress hosting with the features and limits shown on our hosting plans page at the time of your order. These include a set number of WordPress websites, storage space, business email accounts, and a staging environment. We may improve, change, or replace features over time, provided the core service you paid for is not materially reduced during your current billing period.
5. Fair use and resource limits
Our hosting runs on shared infrastructure, so every customer must use resources fairly. You agree not to use the Services in a way that harms the performance, stability, or security of our systems or other customers, for example through excessive CPU, memory, or bandwidth use, running heavy background processes, or using your storage for file distribution or backups unrelated to your websites. If your usage affects other customers, we may limit resources, ask you to move to a larger plan, or, where necessary, temporarily suspend the affected service.
6. Acceptable use and prohibited content
You may not use the Services to host, store, send, link to, or promote:
- child sexual abuse material. We have zero tolerance for this, and we report it to the relevant authorities;
- content that promotes terrorism, violence, or hatred against people or groups;
- malware, viruses, phishing pages, botnets, or any other malicious code or activity;
- spam, unsolicited bulk email, or email sent to purchased or harvested lists;
- fraud, scams, fake shops, or deceptive schemes;
- material that infringes copyright, trademarks, or other intellectual property rights;
- illegal goods or services, or gambling that is not properly licensed;
- harassment, threats, or content that invades another person’s privacy;
- any content or activity that is illegal under the laws of Pakistan or the laws that apply to you.
You must also not attempt to gain unauthorised access to any system, scan or attack networks, or interfere with the Services. This list is not exhaustive. We decide reasonably and in good faith whether content or activity breaks these rules.
7. Your content and responsibilities
You keep full ownership of your Content. You give us only the limited permission we need to store, copy, and deliver your Content in order to provide the Services. You are solely responsible for your Content and for making sure you have the right to use it. We do not routinely monitor Content, but we may review or remove it when we receive a complaint or have reason to believe it breaks these Terms or the law.
You are responsible for keeping WordPress, themes, and plugins on your websites up to date and secure. Our staging environment is provided to help you test updates safely.
8. Backups and data
Every plan includes daily automatic backups, plus a set number of manual backups you can create yourself (2 on Basic, 3 on Business, and 5 on Advanced). Backups are provided to help you recover from problems, but we cannot guarantee that every backup will be complete or restorable. You remain responsible for keeping your own copies of important websites, databases, and emails. To the extent permitted by law, we are not responsible for lost or corrupted Content.
9. Billing, payments, and renewals
- Plans are billed monthly in advance, in Pakistani rupees (PKR), at the prices shown when you order. Any applicable taxes are added where required.
- Your plan renews automatically at the end of each billing period until you cancel it.
- If a payment is not received by its due date, we may suspend the Services until the account is paid. Accounts that remain unpaid may be terminated, and their Content deleted.
- We may change our prices. We will give you reasonable advance notice, and new prices apply from your next billing period after the notice.
- Apart from our Money-Back Guarantee, or where the law requires otherwise, fees that have already been paid are non-refundable.
10. Money-back guarantee
New customers are covered by our 100% Money-Back Guarantee. If you cancel within 3 days of your first payment for a new hosting account, you receive a full refund of that payment, subject to the conditions on the Money-Back Guarantee page.
11. Cancellation
You can cancel your plan at any time from the client area or by contacting us. Unless your cancellation qualifies for the Money-Back Guarantee, the Services stay active until the end of the current paid billing period and are not renewed. Download any Content you want to keep before your Services end, because it is removed after cancellation.
12. Suspension and termination
We may suspend or terminate the Services, remove Content, or close your Account if you break these Terms, fail to pay, put our systems or other customers at risk, or if the law requires it. For serious breaches, such as illegal content, malware, spam, or attacks, we may act immediately and without notice. For less serious issues, we will normally give you notice and a reasonable chance to fix the problem first. Fees are not refunded when Services are suspended or terminated because of a breach of these Terms.
13. Copyright complaints
If you believe Content hosted with us infringes your copyright, please send a notice through our contact page with: your contact details; a description of the copyrighted work; the exact location (URL) of the infringing material; a statement that you believe in good faith that the use is not authorised; and a statement that the information in your notice is accurate and that you are the rights owner or authorised to act for them. We may remove or disable access to the material and notify the customer, who may respond with a counter-notice. We may terminate the Accounts of repeat infringers.
14. Intellectual property
Our website, branding, logos, designs, and written content belong to us or our licensors. You may not copy or reuse them without our written permission. These Terms do not transfer any of our intellectual property to you, other than the right to use the Services during your subscription.
15. Service availability and maintenance
We work hard to keep the Services running reliably, but we do not guarantee that they will be uninterrupted or error-free. We may carry out planned maintenance and will try to schedule it to keep disruption to a minimum. Interruptions can also be caused by events outside our control, such as network failures, third-party outages, attacks, or natural events.
16. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided€œas is†and€œas availableâ€, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential losses, including lost profits, revenue, data, or business opportunities, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us for the affected Services in the three months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
18. Indemnification
You agree to defend and compensate us for any claims, losses, or costs, including reasonable legal fees, that arise from your Content, your use of the Services, your end users’ use of your websites, or your breach of these Terms or the law.
19. Governing law and disputes
These Terms are governed by the laws of Pakistan. If a dispute arises, please contact us first. We will try to resolve it informally within 30 days before either party takes formal action. Any dispute that cannot be resolved informally will be handled by the competent courts of Pakistan, without affecting any mandatory consumer rights you have where you live.
20. Changes to these terms
We may update these Terms from time to time. When we do, we will update the€œLast updated†date above. For significant changes, we will notify you by email or in the client area. If you keep using the Services after the changes take effect, you accept the updated Terms. If you do not agree, you may cancel your Services.
